Since taking office, President Trump has put into action a wide range of executive actions that implement the ambitious agenda for which he was elected. With Congressional Democrats mostly feckless in their opposition, and the Republicans much more supportive than in the first term, the left has turned to their like-minded judges on the federal bench to throw roadblocks in front of just about every initiative. With plaintiffs such as the ACLU, blue state attorney generals, and selected illegal immigrants with deportation cases, the “judge shopped” federal district jurists (many in Washington DC) have stretched the limits of their power to block the administration’s actions country-wide. 26 out of 30 of the judges (87%) in these cases were chosen by Democrat Presidents and have clearly shown their bias.

What is the precedent for all this and what are the tools available to fight it? For some thoughts on this and the role that Congress and the Supreme Court will play in its evolution, join us as Professor Todd unpacks this historical assault on the separation of powers.

Dr. James Todd joined the Palm Beach Atlantic faculty in 2015, and is currently the Academic Affairs Director for the LeMieux Center for Public Policy. He specializes in American governmental institutions and constitutional law. Dr. Todd serves as an academic advisor to the pre-law students at PBA and directs the PBA Mock Trial team, which he founded in 2016. Dr. Todd teaches the subjects of American government and politics, constitutional law, political science research methods, the Freedom in American Society course, and courses in the humanities sequence. He won the 2023 Charles and Hazel Corts Award for Outstanding Teaching.

Dr. Todd’s research and writing focus on the Supreme Court’s influence on American society. His research has appeared in the Journal of Law and Courts and the Journal of Supreme Court History. He regularly gives public talks and media commentary about the Constitution, the Supreme Court, and American politics in the West Palm Beach area.

Dr. Todd received a Ph.D. in political science and a J.D. degree, both from the University of Alabama. Prior to his academic appointment, he was a practicing attorney for 10 years.
